UPDATED : (APC Crisis) Ganduje faction loses as court dismisses applications

An FCT High Court on Thursday struck out an application by the Gov. Abdullahi Ganduje led faction of APC in Kano for a stay of execution.

Solacebase reports that Justice Hamza Muazu refused the application following an order of the court nullifying the ward and local government Congresses of All Progressives Congress conducted in the state, by the Ganduje led faction that produced Abdullahi Abbas as Chairman.

The Ganduje-led faction not satisfied with the decision of the court, filed a motion seeking the court to stop proceeding and set aside its decision on the ward congress.

However, delivering the ruling , the judge dismissed their motion and fined them N1million for filing frivolous and time-wasting motions.

The court further held that the local government congress conducted by the Senator Shekarau faction remains valid and that they have the right to elect the state exco.

The applicants in the suit are Muntaka Bala Sulyman with 17, 980 members of the party, while the defendants are APC as first defendant, Mai- Mala Buni, Caretaker Chairman; Sen. John Akpanudoedehe, National Secretary and; Independent National Electoral Commission, as the fourth defendant.

At the court sitting on Thursday, Justice Hamza Muazu dismissed all the applications because the applications are incompetent on grounds that there is another appeal pending on the matter at the court of appeal by the defendants.

The plaintiff counsel in the suit, Barrister Nuraini Jimoh argued that the applications be strike out as they are frivolous.

The defendants’ counsels, Barr. Steve Adehi and M.N. Duru argued that the applications be granted

Recall that parallel congresses were held in Kano, with Abdullahi Abbas emerging chairman of the Ganduje-led group and Ahmadu Haruna Zago emerging chairman of the Shekarau-led group.
