Kano State House of Assembly has summoned the state chief judge to appear before it over an issue.
Solacebase was reliably informed that the issue has to do with a court order issued against the assembly restraining the investigation of suspended anti-corruption chairman, Muhuyi Magaji Rimingado.
Muhuyi Magaji Rimingado was suspended on July 5th by the assembly over a petition against him by the state Accountant General on the rejection of chief accountant posted to his commission.
The assembly later on July 12 invited Muhuyi Rimingado to appear before its ad-hoc committee investigating the issue on July 14.
However, Counsel to Muhuyi appeared at the assembly, Barr. U.U. Fari on July 14 with a medical report to substantiate that the suspended chairman was sick and a letter requesting for certified true copy of the petition against his client, certified true copy of the assembly resolution on July 5th with press releases on the suspension.
On July 22 , the National Hospital Abuja wrote a letter to the state assembly dated July 19 replying the house letter on the medical report submitted by Muhuyi Magaji stating that the medical report is not authentic.
With this Muhuyi Magaji wrote through his lawyer to his doctor, Bayo Ayodele threatening to take legal action against him, if he does not clarify the letter from National Hospital on his medical report as those were presented to him by the doctor.
Solacebase reports that a Kano High Court presided by Justice Sanusi Ado Ma’aji gave an order on July 23rd restraining the state assembly from an ongoing investigation of the suspended Chairman of the state public complaints and anti- corruption commission, Muhuyi Magaji Rimingado over a petition written against him by the state Accountant General over rejection of a chief accountant posted to the commission.
However , despite the court order the assembly on Monday, July 26th proceeded with the matter and made five resolution among which was a recommendation to the governor to sack the suspended anti-corruption boss.
Also the assembly in its resolution , recommended to the police commissioner to arrest and prosecute Muhuyi Rimingado for presenting an alleged fake medical report to its ad-hoc committee investigating the petition against the suspended anti-graft czar.
It similarly asked the Accountant General of the State to direct the rejected Chief Accountant to resume at the Commission, adding that the accountant already with commission who is a level 4 officer should be dealt with according to civil service rule, while a committee was asked to investigate the finance of the commission since 2015 to date within three months.
In the invitation letter to the Chief Judge, Justice Nura Sagir Umar, dated July 26th and signed by Barr Nasidi asked the CJ to appear before a committee of the house on Wednesday July 28th.
Solacebase gathered that the CJ ignored the invitation as he neither honour it nor reply the letter.
Speaking to Solacebase on Friday on the development, Spokesman of Kano State Judiciary, Baba Jibo Ibrahim confirmed that the house indeed invited the chief judge of the state to appear before a committee.
‘’How can a committee of the assembly invite the CJ for what? Is it an administrative or judicial issue?
‘’ If it is judicial issue , the assembly does not have constitutional right to invite any judge on any issue talk less of the CJ. Also, if the issue is administrative, they are suppose to invite the Chief Registrar, ‘’said Baba Jibo Ibrahim.
Solacebase contacted Chairman, Nigerian Bar Association, Barr. Aminu Sani Gadanya to find out if it is normal for the Assembly to summon the CJ , asked our correspondent to hold on a little
Barr. Gadanya later confirmed the development and expressed surprise over the issue noting that it is an aberration.
‘’As far as we are concern, the NBA as a promoter of rule of law, so for the legislators not even the house as a whole it was a committee that invited the CJ, it is absurd and unheard of in law.’’
‘’If the assembly is not comfortable over a matter or an order against it, the best thing for the house is to apply to set it aside or appeal the order.’’
‘’They cannot even invite any judge in the state over any matter as you are quite aware that there are three arms of government, that is the Legislature , Executive and Judiciary.’’
‘’ The CJ is the head of the judiciary and the judiciary is independent. For them to be inviting the CJ over an order or a matter that affect them is wrong because they are an interested party. So are they trying to intimidate the umpire ,the judiciary or what?
‘’I am sure it was done in error as I know for sure that the Speaker will not support this act,’’ said the NBA Chairman.
‘’I am even surprise that the letter inviting the CJ was signed by a Lawyer and a member of the NBA.’’
Meanwhile, Solacebase reliably gathered that Justice Sanusi Ma’aji , who granted the order restraining the how on the investigation of a petition against Muhuyi Magaji has return the case file of the matter.
Recalls that Solacebase reported plot to remove the chairman of the Kano State Public Complaints and Anti-Corruption Commission, PCAC, Muhuyi Rimingado, has thickened as Governor Abdullahi Ganduje allegedly mounts pressure on the State Assembly to execute the hatchet job.
Informed sources at the Assembly told Daily Nigerian that the governor wanted the legislators to remove the state anti-corruption commission boss for poke nosing into his family’s affairs.
“You know in the governor’s usual antics of pushing the legislature to take the bullet for him. Remember he did the same when he wanted to get rid of his former deputy, Hafiz Abubakar and former Emir Muhammadu Sanusi II,” said a legislator familiar with the plot.
On the possibility of executing the governor’s bidding, the lawmaker said majority members of the Assembly are rubber-stamps.
The crisis began early weeks back when Mr Rimingado beamed his searchlight into the contracts allegedly awarded to companies linked to the governor’s family.
In a letter with reference number PCACC/CM/OFF/VOL.1/071 dated June 10, 2021, and signed by the chairman of the commission, Muhuyi Rimingado, the commission requested the commissioner of the Ministry of Works to provide information relating to construction of Cancer Center and the supply of diesel by the state government.
