The Appeal Court Kaduna division has set Monday 11th November 2019 for hearing and adoption of the brief of arguments on the Kano Guber Election Petition between Engr Abba K Yusuf, his party the PDP and Kano State Governor Abdullahi Umar Ganduje and the All Progressive Congress.
The parties in the suit were notified on Thursday by the Appeal Court.
Solacebase reports that the Appeal Court has up to 30th November 2019 to pronounce judgment on the petition.
According to section 285 of the fourth alteration of the constitution 1999 as amended, the Appeal Court has 60 days to deliver judgment from the day the tribunal delivered its ruling on the election.
Solacebase recalled that the Kano election petition tribunal on October 2, Upheld the electoral victory of Abdullahi Ganduje as the winner of the March, 2019 governorship election.
However, the Court of Appeal sitting in Kaduna on Wednesday reaffirmed the electoral victory of a member representing Fagge Federal Constituency of Kano at the House of Representatives Aminu Sulyman.
The PDP and its candidate in the election, Ibrahim Jubrin Fagge had challenged the INEC declaration of Aminu Sulyman as the winner in the February 2019 election at the tribunal.
Solacebase recalled that the election petition tribunal in Kano upheld the electoral victory which the petitioners were dissatisfied hence the appeal filed in Kaduna.
