The Court of Appeal sitting in Kaduna on Wednesday reaffirmed the electoral victory of a member representing Fagge Federal Constituency of Kano at the House of Representatives Aminu Sulyman.
The PDP and its candidate in the election, Ibrahim Jubrin Fagge had challenged the INEC declaration of Aminu Sulyman as the winner in the February 2019 election at the tribunal.
Solacebase recalled that the election petition tribunal in Kano upheld the electoral victory which the petitioners were dissatisfied hence the appeal filed in Kaduna.
In her lead judgment on Wednesday, Justice Adefope Okojie ruled that the election was held in consonance with the 2010 electoral act as amended and upheld the ruling of the lower court.
However, last week,The Kaduna division of the Court of Appeal nullified the election of Abdulmuminin Jubril, of All Progressive Congress, (APC)representing Kiru/Bebeji Federal Constituency in the House of Representatives.
The court then ordered INEC to conduct a fresh election within 60 days between Ali Datti of the PDP and Abdulmuminin Jubril of the APC in Kano. Solacebase reports that the judgement was read by Justice Ajoke Adepoju.
Solacebase recalled that the National and State Assembly Election Petitions Tribunal sitting in Kano on September 5, 2019, had upheld Abdulmuminin Jubril electoral victory.
