The Court of Appeal sitting in Kaduna on Monday upheld the appeal of Peoples Democratic Party (PDP) and it Governorship candidate in Kano Abba Kabir Yusuf to present additional witnesses at the election petition tribunal.
In its judgment on Monday, the five-man Justices led by Justice A.O Okojie said the lower court erred in law for refusing PDP tenders its additional witnesses as they were already part of the petition though not on the list of witnesses.
Solacebase recalled that an interlocutory application was filed after the July 16 ruling that the 8 additional witnesses by the PDP cannot be allowed.
The court of appeal last Friday heard all the parties in the appeal.
The appellants include Abba Kabir Yusuf and the PDP while the respondents in the matter were APC, INEC and Abdullahi Umar Ganduje
Solacebase learnt that the APC , INEC and Abdullahi Ganduje legal teams have vowed to challenge the judgment at the Supreme Court.
