The Supreme Court on Tuesday affirmed the election of Nasiru Abduwa as the duly elected candidate of All Progressive Congress and winner of the Gezawa/Gabasawa federal constituency election of Kano state.
A five man justices of the apex court led by Justice Ejembi Eko set aside the judgement of the Appeal Court that recognized Mahmoud Muhammed as the candidate of the party and winner of the election
Solacebase recalled that the Kaduna division of the Court of Appeal on 18th April 2019 had ordered that Independent National Electoral Commission issue Mahmoud Muhammed certificate of return as the elected House of Representatives member representing Gabasawa Federal Constituency in Kano state.
The Supreme Court while allowing the appeal faulted the decision of the Court of Appeal, noting that the lower court erred and upheld the judgment of the Kano High Court delivered by Justice Nasiru Saminu on 20th February.
The Appellants in the suit are Nasiru Abduwa and the All Progressive Congress with Mahmoud Muhammad and Independent National Electoral Commission as Respondents.
The apex court ordered the parties in the suit to bear their respective cost.
The second appellant, All Progressive Congress conducted the primary election on 3rd October 2018 in which Nasiru Abduwa emerged the candidate of the party but was contested at the Kano High Court in February 2019.
