Kano APC chairman challenges court jurisdiction to hear Danzago’s suit

The legal battle rocking the leadership of All Progressives Congress (APC) in Kano on Tuesday took fresh dimension as the party Chairman, Alhaji Abdullahi Abbas and Secretary Zakari Sarina moved a preliminary objective before the Federal high court sitting in Kano against the suit filed by leader of the aggrieved members Alhaji Ahmadu Haruna Danzago.
Solacebase reports that Danzago had applied for an order of interlocutory injunction before the court, challenging the process that returned Abbas and Sarina as substantive Chairman and Secretary in the October 2021, state Congress.
When the matter came up for hearing before Justice A. M Liman, on Tuesday, the defendants, through their solicitor, Barrister Chief M.N Duru, challenged the jurisdiction of the court to hear the suit.
Duru argued that since the originating summon on the matter borders on intra-party affairs, the matter ought not to be taken or challenged before any competent court of law in the first instance.
The senior lawyer maintained that the provision of the party’s constitution requires party members to explore all internal mechanisms to resolving their internal crisis.

In the injunction, Danzago through his attorney, Barrister Christopher Oshomeghe, asked the court to restrain Abbas and Sarina from parading themselves as Chairman and Secretary of the party on the ground that both of them did not resigned their positions as caretaker executives before contested the substantive positions.
The application could not scale through because the plaintiff had not serve the third dependent (APC), with notice of service.
Meanwhile, counsel to the plaintiff who did not objected to the respondent preliminary objection however asked the court to hear the originating summon which already served all the parties.
Justice A. M Liman, in his ruling, did not consented to the plaintiff’s plea. The judge however adjourned the matter till 18th of May, for hearing and determination of all the applications before him.
Danzago’s fresh legal battle is coming after the recent verdict of the Supreme Court which validated the Governor Abdullahi Umar Ganduje’s anointed party chairman, Abbas.
Danzago, a critical stakeholder of the G7 APC group under the leadership of Senator Ibrahim Shekarau, had lost the bid to reclaim the ward and local government congresses against the congresses conducted under the leadership of Abbas.
